Bikers rely on the condition of the roads
more than any other road users and a deflection caused by a pothole or loss of grip
due to gravel or mud can have devastating
consequences. Motorbike accidents and resultant injuries are often
particularly severe due to the vulnerability of the rider. During
February 2009 following a long period of freeze/thaw conditions AA Insurance recorded
a 300% increase in road damage-related motorcycle accidents. It is therefore
important that serious road damage is reported to the relevant Highways
Authority to enable repairs to be made as soon as possible.
Anyone injured by
a pothole or whose vehicle is damaged by a pothole is entitled to claim for
compensation but local authorities have a defence against claims if they were
unaware of the defect in the road prior to the incident, (Section 58 of the
Highways Act 1980). Yet another reason for ensuring that the relevant authority
is made aware of such highway hazards.
